Privacy Policy

  1. This Privacy Policy pertains to the following platforms: MMAI Angel (“App”) and MMAI Angel (“Website”). Uplift Works Inc. (“Company”; “we”; “us”; “our”) respects the privacy of all users (“user”; “you”), including those using our website located at mmaiangel.com, our App MMAI Angel, other media forms, media channels, all of which are collectively referred to herein as the “Platform.” The following Company Privacy Policy (“Privacy Policy”) is designed to inform all users of the Platform about the types of information that Company may gather about or collect from you in connection with your use of the Platform and any services you request. This Policy is also intended to explain the conditions under which Company uses and discloses that information, and your rights as they relate to that information. Changes to this Privacy Policy are discussed at the end of the document in a section titled “Privacy Policy Changes.” Each time you use the Platform, the current version of this Privacy Policy applies. Please refer to the version date at the top right of this Privacy Policy to find the version date that applies to you and be sure to review any changes that were made since the last time you used the Platform.

Our Platform is hosted in the United States of America and is subject to U.S. state and federal law. If you are accessing our Platform from jurisdictions outside of the U.S., please be advised that you are transferring your personal information to us in the U.S., and by using our Platform, you consent to that transfer and use of your personal information in accordance with this Privacy Policy. In using our Platform, you also agree to abide by the applicable laws of applicable states and U.S. federal law concerning your use of the Platform and your agreements with us. Any users accessing our Platform from any jurisdiction with laws or regulations governing the use of the Internet, including personal data collection, use and disclosure from those of the jurisdictions mentioned above may only use the Platform in a manner that is lawful in their jurisdiction. If your use of our Platform would be unlawful in your jurisdiction, please do not use the Platform.

2. By using or accessing the Platform, you are accepting the practices described in this Privacy Policy

  1. Personally-Identifying Information: Information such as name or email address that, without more, can be directly associated with a specific person.
  2. Non-Personally-Identifying Information: Information that, absent additional information, cannot be directly associated with a specific person.
  3. Web Cookie: A string of information that assigns Web users a unique identification that websites store on the user’s computer. The user’s browser provides a unique ID to the site each time the user submits a query to the site.
  4. Web Beacon: An object that is embedded in a web page or email that is usually invisible to the user and allows website operators to check whether a user has viewed a particular web page or an email.

 

  1. The Children’s Online Privacy Protection Act (“COPPA”) protects the online privacy of children under 13 years of age. We do not knowingly collect or maintain personal information from anyone under the age of 13, unless or except as permitted by law. Any user who provides personal information through the Platform represents to us that they are 13 years of age or older. If we learn that personal information has been collected from a user under 13 years of age on or through the Platform, then we will take the appropriate steps to delete this information. If you are the parent or legal guardian of a child under 13 who has become a member of the Platform or has otherwise transferred personal information to the Platform, please contact Company at support@mmaiangel.com to have that child’s account terminated and information deleted.

 

  1. Gathering, Use, and Disclosure of Non-Personally-Identifying Information. 
  1. Users of the Platform Generally. Like most website operators, Company gathers Platform user’s Non-Personally-Identifying Information of the sort that Web browsers, depending on their settings, may make available. That information includes user Internet Protocol (IP) addresses, operating systems, browser types, and the locations of Web pages that the user views immediately before arriving at the Platform, during their navigation to it, and after leaving. Although such information is not personally identifiable, it may be possible for Company to determine, from an IP address, a user’s Internet Service Provider (ISP), the geographic location of the visitor’s point of connectivity, and other statistical usage data. Company analyzes Non-Personally-Identifying Information gathered from Platform users to help Company understand user needs. Identifying patterns and trends in usage gives Company the ability to cater services and content to user needs and make the Platform more user-friendly. Company may release Non-Personally-Identifying Information gathered from Platform users in the aggregate, such as by publishing a report on trends in the usage of the Platform.
  1. Web Cookies. We use cookies on the Platform to keep track of services you have used, to record registration information regarding your login name and password, to record your user preferences, to keep you logged into the Platform, and to facilitate purchase procedures. Company also uses Web Cookies to track the pages you visit during each Platform session, both to help improve user experience and to help Company understand how the Platform is being used. As with other Non-Personally-Identifying Information gathered from users, Company analyzes and discloses aggregated information gathered using Web Cookies to help Company, its partners, and others better understand how the Platform is being used.

Platform users who do not wish to have Web Cookies placed on their devices should set their browsers to refuse Web Cookies before using the Platform, with the understanding that certain features may not function properly without the aid of Web Cookies. Any user who refuses Web Cookies assumes full responsibility for all resulting loss of functionality. 

  1. Third Party Advertisers. We may use third-party advertising companies to display advertisements (“ads”) when you visit the Platform. These companies may use Non-Personally-Identifying Information about your visits to this and other platforms in Web Cookies to provide ads about goods and services of interest to you. Using a tool created by the Network Advertising Initiative, you can opt out of several third-party ad servers’ and networks’ Web Cookies simultaneously. We may allow advertisers to choose the characteristics of users who will see their advertisements, use any of the non-personally identifiable attributes we have collected (including information you may have decided not to show to other users, such as your birth year or other sensitive personal information or preferences) to select the appropriate audience for those ads. Company does not reveal user identity to the advertiser.

  1. Web Beacons. Company may use Web Beacons on the Platform and in emails to count users who have visited particular pages, viewed emails, and to deliver co-branded services. Web Beacons are not used to access users’ Personally-Identifying Information, rather they may be used as a technique to compile aggregated statistics about Platform usage. Web Beacons collect only a limited set of information including a Web Cookie number, time and date of a page or email view, and a description of the page or email on which the Web Beacon resides. You may not decline the Web Beacons; however, they can be rendered ineffective by declining all Web Cookies or modifying your browser setting to notify you each time a Web Cookie is tendered and permit you to accept or decline them on an individual basis.

 

  1. Company may use third-party vendors, including Google, who use first-party cookies (such as the Google Analytics Cookie) and third-party cookies together to provide analytics services, inform, optimize, and serve ads based on your past activity on our websites and applications, including Google Analytics for Display Advertising. These vendors may use Web Cookies, Web Beacons, and other technologies to collect information about your use of the Platform, our service, and other websites, including your IP address, web browser, pages viewed, time spent on pages, links clicked, and conversion information. This information may be used by us and others to, among other things, analyze and track data, determine the popularity of certain content, deliver advertising and content targeted to your interests on our service and other websites to better understand your online activity. Ads for our products and services may appear on third-party websites around the Internet. Some websites and services deliver these ads based upon previously collected data about your past online behavior. This kind of targeted advertising is sometimes called interest-based or online behavioral advertising. We do not control such third-party websites or services on which these ads appear, nor do we control how they collect and use data about your online activities.

 

If you do not want any information to be collected and used by Google Analytics, you can install an opt-out in your web browser (https://tools.google.com/dlpage/gaoptout/) and/or opt out from Google Analytics for Display Advertising or the Google Display Network. You can do so by using Google’s Ads Settings (www.google.com/settings/ads).   1. Aggregated and Non-Personally-Identifying Information.

 

Company may share aggregated and Non-Personally Identifying Information collected under any of the above circumstances. We may also share that information with third parties and our affiliate companies to develop and deliver targeted advertising on our Platform and on third party websites. We may combine Non-Personally Identifying Information we collect with additional Non-Personally Identifying Information from other sources. We may also share aggregated information with third parties, including advisors, advertisers, and investors, to conduct general business analyses. For example, we may tell our advertisers the number of visitors to our Platform and the most popular features or services accessed. This information does not contain any Personally-Identifying Information and may be used to develop website content and services that are of interest to users.

 

  1. Mobile Device Additional Terms.

 

  1. Mobile Device. We may collect device information, such as your IP address, user agent, mobile carrier, time zone settings, identifiers for advertising purposes, model of your device, the device system, network type, device IDs, your screen resolution and operating system, app and file names and types, keystroke patterns or rhythms, battery state, audio settings, and connected audio devices. We automatically assign you a device ID and user ID. When you log in from multiple devices, we will be able to use information such as your device ID and user ID to identify your activity across devices. We may also associate you with information collected from devices other than those you use to log in to the Platform.
  2. Geo-Location Information. Unless we have received your prior consent, we do not access or track any location-based information from your mobile device at any time while downloading or using our mobile applications or services, except that it may be possible for Company to determine from an IP address the geographic location of the user’s point of connectivity, in which case we may gather and use such general location data.
  • Push Notifications. If you choose to receive them, we send you push notifications to let you know when someone has sent you a message, or for other service-related matters. If you wish to opt out from receiving these types of communications, you may turn them off at the device level.
  1. Mobile Analytics. We use mobile analytics software to better understand the functionality of our mobile device software on your phone. This software may record information, such as how often you use the application, your activity on it, and where it was downloaded from. We do not link the information we store within the analytics software to Personally-Identifying Information you submit within the mobile application.

 

  1. Collection, Use, and Disclosure of Personally-Identifying Information.

 

  1. Platform Registration. Company may collect a range of Personally-Identifying Information from and about Platform users. Much of the Personally-Identifying Information collected by Company about users is information provided by users themselves when (1) registering for our service; (2) logging in with social network credentials; (3) participating in polls, contests, surveys, or other features of our service; (4) responding to offers or ads; (5) communicating with us; (6) creating a public profile; or (7) signing up to receive newsletters. That information may include each user’s name, address, email address, and phone number. If you transact business with us, financial information such as your payment method (valid credit card number, type, expiration date, or other financial information) may also be collected. Company may request information about your interests and activities, gender, age, date of birth, username, hometown, other demographic information, and other information that Company may deem to be relevant. Users are under no obligation to provide Company with Personally-Identifying Information of any kind, with the caveat that a user’s refusal to do so may prevent the user from using certain Platform features.

 

By registering with us or using the Platform, you consent to the use and disclosure of your Personally-Identifying Information as described in the “Definitions” and “Collection, Use, and Disclosure of Personally-Identifying Information” sections.

  1. Payment and Transactional Data. When you pay for any of our services, our payment processor collects the financial information required to process your payments, including name, card payment information, bank account number, and billing information. In addition to this Privacy Policy and our Terms of Use, information related to your payments or purchases is also processed according to our payment processor’s services agreement and privacy policy.

 

  1. Company Communications. We may occasionally use your name and email address to send you notifications regarding new Platform services that we think you may find valuable. We may also send you service-related announcements from time to time through the general operation of the service. Generally, you may opt out of such emails at the time of registration or through your account settings, though we reserve the right to send you notices about your account, such as service announcements and administrative messages, even if you opt out of all voluntary email notifications.

 

  1. User Content. When you use our services, we collect Personal Information that is included in the input, file uploads, or feedback that you provide to our services.  (“Content”)

 

By signing up for an account and providing your phone number, you agree to receive informational text messages from us relating to use of the Company service.

 

If you do not want to receive such messages, you may opt out or change your account preferences. Opting out may prevent you from receiving messages regarding updates, improvements, or offers.

  1. Company Disclosures.

 

  1. General Use. We use the Personally-Identifying Information in the file we maintain about you, and other information we obtain from your current and past activities on the Platform to: (1) deliver the products and services you requested; (2) manage your account; (3) provide customer service support; (4) communicate with you by email, postal mail, phone and/or mobile devices about products or services that may be of interest to you, either from us, our affiliate companies, or other third parties; (5) develop and display content and advertising tailored to your interests on our Platform and other sites; (6) resolve disputes; (7) troubleshoot problems; (8) measure consumer interest in our services; (9) inform you of updates; (10) customize your experience; (11) detect and protect is against error, fraud, and other criminal activity; (12) enforce our Terms of Use; and (13) as otherwise described to you at the time of collection. At times, we may look at multiple user accounts to identify issues. In particular, we may examine your Personally-Identifying Information to identify users using multiple user IDs or aliases. We may compare and review your Personally-Identifying Information for accuracy and to detect errors and omissions. We may use financial information or the payment method you provided to process payment for: (1) any purchases made on our Platform; (2) user enrollment in discounts, rebates, and other programs that you elect to participate in; (3) to protect against or identify possible fraudulent transactions; and (4) as needed to manage business.

 

  1. Company will disclose Personally-Identifying Information under the following circumstances:
    1. By Law or to Protect Rights. In certain cases, we may raise or waive any legal objection or right available to us. Such cases include, but are not limited to: (1) when we believe disclosure is appropriate in connection with efforts to investigate, prevent, or take other action regarding illegal activity, suspected fraud or wrongdoing; (2) to protect and defend the rights, property, or safety of our Company, users, employees, and/or others; (3) to comply with applicable law or cooperate with law enforcement; (4) to enforce our Terms of Use or other agreements or policies in response to a subpoena or similar investigative demand, court order, or request for cooperation from a law enforcement or other government agency; (5) to establish or exercise our legal rights; to defend against legal claims; or (6) as otherwise required by law.
    2. Marketing Communications. Unless users opt out of receiving Company marketing materials upon registration, Company may email users about products and services believed to be of interest to users. If a user wishes to opt out of receiving marketing materials from Company, user may do so by following the unsubscribe link in emails from Company, through your account settings, or by contacting us at support@mmaiangel.com.
    3. Third Party Service Providers. Company may share users’ Personally-Identifying Information with authorized service providers that perform certain services on our behalf. These services include: (1) fulfilling orders; (2) providing customer service and marketing assistance; (3) performing business and sales analyses; (4) supporting our website functionality; and (5) supporting contests, sweepstakes, surveys, and other features offered through our Platform. We may also share your name, contact information, and credit card information with our authorized service providers who process credit card payments. These service providers may have access to personal information needed to perform their functions but are not permitted to share or use such information for any other purpose.
    4. Business Transfers; Bankruptcy. Company reserves the right to transfer all Personally-Identifying Information in its possession to a successor organization in the event of a merger, acquisition, bankruptcy, or other sale of all or a portion of Company’s assets. Other than to the extent ordered by a bankruptcy or other court, the use and disclosure of all transferred Personally-Identifying Information will be subject to this Privacy Policy, or to a new privacy policy if you are given notice of that new privacy policy and are given an opportunity to affirmatively opt out of it. Personally-Identifying Information submitted or collected after a transfer, however, may be subject to a new privacy policy adopted by the successor organization.

 

  • Changing Personally-Identifying Information: Account Termination. You may, at any time, review or change your Personally-Identifying Information by going to your account settings or contacting us at support@mmaiangel.com. Upon your request, we will deactivate or delete your account and contact information from our active databases. Such information will be deactivated or deleted as soon as practicable based on your account activity and in accordance with our deactivation policy and applicable law. To make this request, either go to your account settings, or contact us at support@mmaiangel.com. We will retain in our files some personal information to prevent fraud, troubleshoot problems, assist with any investigations, to enforce our Terms of Use, and to comply with legal requirements, as is permitted by law. Therefore, you should not expect that all your personal information will be completely removed from our databases in response to your requests. Additionally, we keep a history of changed information to investigate suspected fraud with your account.
  1. Social Media.

 We may provide you with the option to connect your account on our Platform to your account on some social networking sites for the purpose of logging in, uploading information, or enabling certain features on the Platform. When logging in using your social network credentials, we may collect the Personally-Identifying Information you have made publicly available on the social networking site, such as your name, profile picture, cover photo, username, gender, friends list/network, age range, locale, and any other information you have made public. Once connected, other users may also be able to see information about your social network, such as the size of your network/list and mutual friends. By connecting your account on our Platform to your account on any social networking site, you hereby consent to the continuous release of information about you to us. We will not send any of your account information to the connected social networking site without disclosing it to you first. Each social network may further allow you to set privacy controls around your information on their system, and our collection of information will always follow such controls and permissions. This feature is subject to continuous change and improvement by us, and each social networking site involved. The available features and shared information are subject to change without notice to you.

We may use hyperlinks on our Platform, which will redirect you to a social network if you click on the respective link. However, when you click on a social plug-in, such as for Facebook or X, that plug-in will activate, and your browser will directly connect to that provider’s servers. If you do not click these hyperlinks, none of your data will be sent to the respective social plug-in provider. For example, accessing a social network through our Platform may share the following information with that social network (this is not an exhaustive list): your IP address; browser version; screen resolution; and the operating system of the device you used to access our Platform. Settings regarding privacy protection can be found on the websites of these social networks and are not within our control.

  1. Collection and Use of Information by Third Parties, Generally.

Company contractually prohibits its contractors, affiliates, vendors, and suppliers from disclosing Personally-Identifying Information received from Company, other than in accordance with this Privacy Policy. Third parties are under no obligation to comply with this Privacy Policy, except with respect to Personally-Identifying Information that users provide directly to those third parties or that those third parties collect for themselves. These third parties include advertisers and providers of games, utilities, widgets, and a variety of other third-party applications accessible through the Platform. This Privacy Policy does not apply to information provided to or gathered by the third parties that operate them. Before visiting a third party site or application, whether by means of a link on the Platform, directly through the Platform, or otherwise, and before providing any Personally-Identifying Information to any such third party, users should inform themselves of the privacy policies and practices (if any) of the third party responsible for that website or application, and should take necessary steps to, in users’ discretion, protect their privacy. 

  1. We take security of your Personally-Identifying Information seriously and use reasonable electronic, administrative, and physical measures to protect it from loss, theft, alteration, or misuse. However, please be advised that even the best security measures cannot fully eliminate all risks. We cannot guarantee that only authorized persons will view your information. We are not responsible for third party circumvention of any privacy settings or security measures.

We are dedicated to protecting all information on our Platform, but you are responsible for maintaining the confidentiality of your Personally-Identifying Information by keeping your password and other account information confidential. If you believe someone has gained unauthorized access to your account, you should change your password immediately. If you lose control of your account, please notify us immediately at support@mmaiangel.com.

  1. Your Rights. Depending on your jurisdiction, you may have the following rights with respect to your personal data:
  2. The right to request access to your personal information.
  3. The right to request correction of inaccurate or incomplete information.
  4. The right to request deletion of your personal information, subject to legal obligations.
  5. The right to request limitations on the processing of your data.
  6. Data Portability. The right to request a copy of your data in a structured, machine-readable format.
  7. The right to object to certain types of data processing.

  1. Human Oversight.

We are committed to upholding the highest standards of privacy and data protection in the development and operation of our AI-based Platform. In furtherance of this commitment, we ensure that human oversight is an integral part of our processes to protect your privacy and rights.

 

  1. Purpose of Human Oversight. We incorporate human oversight into our Platform to:
    1. Ensure compliance. Trained personnel regularly review and monitor the functioning of our AI algorithms to ensure they comply with applicable laws, regulations, and ethical standards.
    2. Evaluate accuracy and fairness. Human oversight is used to assess the accuracy, fairness, and effectiveness of our AI Platform, particularly where sensitive information is stored.
  • Address user concerns. Human oversight enables us to promptly address any user concerns, queries, or complaints related to data privacy and AI usage. 
  1. Types of Human Oversight.
    1. Data Scientists and Engineers. Our team of data scientists and engineers train and validate AI models and other related programs/processes, including data selection, annotation, and testing, to minimize biases and errors.
    2. Customer Support and Privacy Specialists. Trained customer support and privacy specialists handle user inquiries, concerns, and complaints related to data privacy and AI usage.

 

  1. Transparency and Accountability. Company is committed to transparency and accountability in our use of AI to provide users with services they request. To this end:
    1. We provide clear and accessible information to users about the role of human oversight in our AI-based Platform in this Privacy Policy and other relevant documentation.
    2. Company maintains detailed records of oversight activities, including decisions made and actions taken, to ensure accountability and traceability.

 

  1. User Rights and Remedies. Users have the right to request information about the human oversight mechanisms employed in our AI-based Platform and how they impact their privacy and rights.
  1. Data Retention.

 We retain information as long as necessary to provide requested services and for other purposes set out in this Privacy Policy. We also retain information when necessary to comply with contractual and legal obligations, when we have a legitimate business interest to do so, such as improving and developing the Platform and enhancing its safety, security, and stability, and for the exercise or defense of legal claims.

The retention periods differ depending on different criteria, such as the type of information and the purposes for which we use the information. For example, when we process your information to provide you with Platform services, we keep this information for as long as you have an account. If you violate our Terms of Use or other conditions or policies, we may remove your profile immediately, but may keep other information about you to process the violation.

  1. Privacy Policy Changes.

 We may update this Privacy Policy from time to time to reflect changes in our practices or applicable laws.  Any changes will be posted on this page with the “Version Date” date.  We encourage you to review this Privacy Policy periodically.

  1. California Privacy Rights. 

California Civil Code Section 1798.83, also known as the “Shine the Light” law, permits CA resident users to inquire about the personal information (if any) we disclosed to third parties for direct marketing purposes in the preceding calendar year. CA residents may inquire about this once a year, free of charge. If applicable, this information would include a list of the categories of personal information that was shared and the names and addresses of all third parties we shared information with in the immediately preceding calendar year. If you are a CA resident and would like to make such a request, please submit your request in writing to our privacy officer at support@mmaiangel.com.

14. Child Sexual Abuse Material (CSAM) Compliance

At MMAI Angel, the protection of minors and the prevention of any child sexual abuse material (CSAM) is our highest priority. We are fully committed to complying with all applicable federal, state, and international laws and regulations designed to combat the creation, distribution, and possession of CSAM. Our measures include, but are not limited to, the following:

  • Strict Prohibition:
    MMAI Angel strictly prohibits the upload, transmission, storage, or sharing of any content that constitutes or depicts child sexual abuse. Any content found to be in violation will be immediately removed.

  • Advanced Monitoring and Filtering:
    Our platform employs state-of-the-art content filtering, monitoring, and detection systems to identify and prevent the distribution of CSAM. These technologies help us ensure that our services remain safe and secure for all users.

  • Mandatory Reporting:
    In the event that our systems or users identify any material that appears to be CSAM, we are obligated to immediately report such findings to the appropriate law enforcement authorities. We cooperate fully with all investigations to help protect minors and hold offenders accountable.

  • User Responsibility and Reporting:
    We encourage users to report any content or behavior that they suspect may violate our policies. Reports can be submitted through our designated reporting channels, and all reports are handled with the utmost urgency and confidentiality.

  • Regular Policy Reviews:
    Our CSAM compliance measures are regularly reviewed and updated to ensure ongoing adherence to legal requirements and to incorporate best practices in content moderation and user safety.

  • Data Protection:
    In addition to our CSAM policies, we are committed to protecting the privacy of our users, especially minors. We collect and process personal data in strict compliance with applicable data protection laws, and we implement robust security measures to safeguard this information.

15. Do Not Track Policy. Our Platform does not respond to “Do Not Track” signals or mechanisms.
